Tom King dba Tom King, 1129 State Street, Erie, PA 16501, on or about December 11, 2018 and times prior thereto: An employee was working from the fiberglass basket of an aerial lift in the elevated position to perform work operations including, but not limited to, changing out lighting fixtures on a pole. The employee was not wearing an appropriate fall restraint device.

29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation: A.) Tom King dba Tom King, 1129 State Street, Erie, PA 16501, on or about December 11, 2018 and times prior thereto: An employee was working from the fiberglass basket of an aerial lift in the elevated position to perform work operations including, but not limited to, changing out lighting fixtures on a pole. The fiberglass basket had a 3.5-inch high and 5-inch wide hole in the bottom corner of the basket. The aerial lift device was not marked out of service, rendered inoperable, and/or removed from the location.
