29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid structure: MCL Mechanical Services, Inc., Burger King, 344 King St., Northampton, Massachusetts; On or about December 13, 2018 employees were using a portable ladder to access the upper roof that did not extend 3 feet above the access point and was not secured to the structure.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. MCL Mechanical Services, Inc., Burger King at 344 King St., Northampton, Massachusetts; On or about December 13, 2018 two employees used a portable ladder that was damaged, including missing rungs and footers to prevent slipping, to access a roof.
