OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards.    a) Dry Goods Area - on or about January 15, 2019, storage of material created a hazard in that steel storage rack location K542 had a serious bent vertical column that was not immediately unloaded and the damaged portion was not repaired or replaced.    b) Dry Goods Area - on or about January 15, 2019, storage of material created a hazard in that steel storage rack location P202 had a serious bent vertical column that was not immediately unloaded and the damaged portion was not repaired or replaced.    c) Dry Goods Area - on or about January 15, 2019, storage of material created a hazard in that steel storage rack location M542 had a serious bent vertical column that was not immediately unloaded and the damaged portion was not repaired or replaced.    d) Cooler - on or about January 15, 2019, storage of material created a hazard in that steel storage rack location G532 has two damaged vertical columns secured with a ratchet strap and the column plate for one of the vertical columns unsecured to the floor, this rack was not immediately unloaded and the damaged portion was not repaired or replaced.     e) Cooler - on or about January 15, 2019, storage of material created an overhead hazard in that steel storage rack constructed between two racking systems location G532, constructed above a walking/working surface had a serious bent horizontal column that was not immediately unloaded and the damaged portion was not repaired or replaced.    Among other methods, one feasible and acceptable means of abatement would be to isolate the damaged portions of the racks until the damaged portion is evaluated by a storage rack design professional to certify that the rack system or repaired components have been restored to at least their original design capacity in accordance with ANSI MH16.1:2012, Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks, Section 1.4.9.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) 11221 Ford Rd. Bensalem, PA - on or about January 15, 2019, employees operated powered industrial trucks for warehousing operations, but the employer did not ensure that each operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of training and evaluation.    b) 1221 Ford Rd. Bensalem, PA - on or about January 15, 2019, employees operating powered industrial trucks for warehousing operation, instances where training certifications were provided, it was found the operators were not provided training consisting of formal instruction such as but not limited to lecture, discussion, interactive computer learning, video tape, or written materials.    c) 1221 Ford Rd. Bensalem, PA - on or about January 15, 2019, the employer did not provide refresher training to employees to include evaluation to ensure the operator had the knowledge and skills needed to operate the powered industrial truck safely when the operator had been involved in an accident or near-miss or at least once every three years.    d) 1221 Ford Rd. Bensalem, PA - on or about January 15, 2019, employees operated powered industrial trucks for warehousing operations, instances where training certifications were provided, the employer did not include the date of training on the employee certification.
