OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  Precision Tune Auto Care, Macon, GA-On or about December 19, 2018 and times prior to, in the automotive repair maintenance bay, employees operated six automotive lifts:  Bay 1: Hunter 7,000Lb In-Ground Single Post Lift - Model: D-Rack - Serial #: 70-1634 Bay 2: Ben Pearson 12,000Lb 4 post lift - Model:LMT12 - Serial #:26316 Bay 3: Ben Pearson 22,000lb 4 post lift - Model:LMT22 - Serial #: 35671 Bay 4: Lazarus Auto Warehouse 11,000Lb 2 post lift - Model:TP11KAC-D - Serial#: 47779-14 Bay 5: Ben Pearson 9,000lb 2 post lift - Model:LMP9 - Serial #: 41174 Bay 6: Ben Pearson 9,000lb 2 Post lift - Model:LMP9 - Serial #: 41175    The lifts were modified and damaged to elevate vehicles; the employer also failed to inspect the automotive lift and document them per manufacturer's recommendations; and employees had not been trained and documented.    Among other methods, feasible and acceptable methods to correct these hazards would be to comply with the safety requirements for the operation, maintenance and inspection of automotive lifts outlined in the ANDI approved Automotive Lift Institute standard ALOIM-2008, Section 4.2.1 Operator Training, Section 5.1 Periodic Inspections, Section 6.1 Maintenance and Section 7 Modifications.

29 CFR 1910.28(b)(11)(i): Each employee exposed to an unprotected side or edge of a stairway landing that was 4 feet (1.2 m) or more above a lower level was not protected by a guardrail or stair rail system:  Precision Tune Auto Care, Macon, GA - Employees were exposed to an 8' 10" fall hazard when they accessed the stairs to the upper office/break room without a guardrail system or other means of protection.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure:  Precision Tune Auto Care, Macon, GA -  On or about December 19, 2018, and times prior to, extension cords and power strips were observed in the production area, such as, but not limited to:   On the stairs - Extension cord and power strip that supplied power to the printer, monitor, and computer.  Also, under the stairs, an electrical outlet used to supply power to the power strip did not have a cover.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Precision Tune Auto Care-On or about December 19, 2018, the employer had developed, but had not implemented, a written hazard communication program where employees were exposed to chemicals including, but not limited to coolant, Purple Power, motor oil, brake fluids, anti-freeze, brake parts cleaner, brake fluid, transmission fluid, air conditioning refrigerant, gasoline, etc.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  Precision Tune Auto Care-On or about December 19, 2018, the employer had developed, but had not implemented, a written hazard communication program where employees were exposed to chemicals including, but not limited to; coolant, Purple Power, motor oil, brake fluids, anti-freeze,  transmission fluid, air conditioning refrigerant, gasoline, etc. Safety Data Sheets (SDS) for Purple Power, and brake parts cleaner, were not readily accessible to employees and the employer had not conducted Globally Harmonized training as required by the standard.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(3)(iv): Employees had not been provided with GHS 2012 training including an explanation of the labels received on shipped containers and the workplace labeling system to be used by their employer; the safety data sheet, including the order of information, and how employees can obtain and use the appropriate hazard information:  Precision Tune Auto Care-On or about December 19, 2018, the employer had developed, but had not implemented, a written hazard communication program where employees were exposed to chemicals including, but not limited to coolant, Purple Power, motor oil, brake fluids, anti-freeze, brake parts cleaner, brake fluid, transmission fluid, air conditioning refrigerant, gasoline, etc. The employer had not identified hazardous chemicals and information and training under the new globally harmonized system (GHS) such as, but not limited to labeling system, pictograms, and Safety Data Sheets had not been conducted.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
