29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:    Construction site: On or about January 24, 2019, employees were observed operating a rough terrain fork lift without having completed training prior to operating the equipment.  This condition exposed employees to struck-by hazards.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.    Construction Site:  On or about January 24, 2019, an employee was observed leaving a JLG forklift elevated to the top of a second story roof as the employee left the area.  This condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     Construction Site: On or about January 24, 2019, employees engaged in roofing activities were not protected from a fall by a fall protection system.  This condition exposed employees to a fall hazard above 6 feet.
