OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm:     a) Dumping Area:  A Case CX160 track excavator was being operated to level and push down materials inside a forty (40) cubic yard refuse roll off container while an employee was performing ground cleaning and support activities, resulting in the employee being caught between the container and a concrete block retaining wall, on or about January 23, 2019.        Abatement Certification and Documentation Required.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a) Dumping area: Employees were exposed to a 7 foot fall hazard along the dumping area wall, as observed on or about January 23, 2019.  Abatement Certification Required.
