29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about January 25, 2019 and at times prior thereto, Stermer Distribution Equipment Rental & Excavation Services, as the creating and correcting employer, did not ensure each employee of Construct Capital, subcontractor, in an excavation were protected from cave-in hazards. Employer did not use an adequate protective system in accordance with OSHA 1926.652(c) standards. The following condition exposed the employees to crushing and engulfment hazards by trench wall cave-ins: 1. Sloping and/or benching was not selected and constructed by the employer or his designee. 2. Tabulated data was not designed by an registered professional engineer when trenching adjacent to and under a building/structure, its foundation and an active roadway. 3. A copy of the design, tabulated data was not maintained on the jobsite for the protective system.
