OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to struck by hazards: On or about January 30th, 2019 and at times prior thereto employees walked, worked, and operated forklifts in proximity of storage racks inside the warehouse, and were exposed to struck-by and/or crushed by metal racks and stored materials in the event of a collapse of the free standing, unanchored metallic storage racks The owner did not maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures in order to correct deficiencies including (but not limited to) the following: a) Warehouse - The rack system was free-standing and was not anchored to the floor while employees accessed the unanchored racking system with standing and sitting forklift devices, on or about January 30th, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
