On or about January 29, 2019, located at the Heritage Town Center at Building #3, the employer did not instruct the employees in the recognition and avoidance of unsafe conditions and the regulations applicable to framing work and its environment when employees were exposed to fall and struck-by hazards.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.   a. On or about January 29, 2019, located at the Heritage Town Center at Building #3, employees were performing a below-the-tine lift of a 10 foot by 20 foot framed wall with the use of a Genie GTH-844 Rough-Terrain Forklift. The lifting of the suspended load affected the safe operation of the forklift and was against manufacturers recommendations; thereby exposing the employees to a struck-by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about January 29, 2019, located at the Heritage Town Center at Building #3, employees were hoisting a 10 foot by 20 foot framed wall with the use of a rough-terrain forklift. An employee was on the second-story floor to assist in guiding the wall without any means of fall protection, thereby exposing the employee to a fall of approximately 10 feet 6 inches.  Marvin Cruz was previously cited for a violation of this Occupational Safety and Health Standard which was contained in OSHA inspection number 1134211, citation number 1, item number 1 and was affirmed as a final order on June 29, 2016 with respect to a workplace located at 236, 238 Stone Shire Crossing/300, 302 Stone Shire Loop Pataskala, Ohio 43062.
