29 CFR 1926.760(b)(3): Each connector working at heights over 15 and up to 30 feet above a lower level, was not provided with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or was not provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section:  a) At the top of the steel structure, on or about January 30, 2019 an employee was not wearing a harness and lanyard and did not have an anchor point available while positioned on the steel connecting roof braces, exposed to a twenty-eight-foot fall hazard.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: (Construction Reference:  1926.602(d))  a) At the jobsite, on or about January 30, 2019 and at times prior to, an employee who operated an Extreme Manufacturing XRM1245 telehandler was not provided with formal instruction to operate powered industrial trucks and the employer had not performed an evaluation of that operator's performance in the workplace.
