29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  Location: 120 Old Post Rd. Rye NY 10580: 2nd Fl of building 4  a) On or about February 5, 2019, employees accessed a job-made ladder that was approximately 10 feet in length. The ladder had filler blocks that were not the same thickness as the cleats, as stated in American National Standard A14.4-1979, 4.5.2 Filler Blocks.   American National Standard A14.4-1979, 4.5.2 Filler Blocks. Filler blocks of the same thickness as the cleats shall be inserted between cleats and shall be butted tightly against the underside of each cleat. The filler blocks shall be nominal 1 X 2 strips for 1 X 4 cleats and 2 X 2 strips for 2 X 4 cleats. Attachment of filler blocks shall be accomplished using three 1 ()'d common nails for 1 X 2 strips or three 12-d common nails for 2 X 2 strips while maintaining a 1-1/2 inch end distance for the top and bottom nails on filler blocks.
