29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On Dec. 19, 2018, there were no frequent and regular inspections being performed by a competent person in that:  (a) employees were using two portable extension ladders as roof access for two 3-story apartment buildings that did not extend 3 feet above the upper landing surface    (b) employees were using a pneumatic nail gun without eye protection    (c) employees were working on a low-slope pitch roof structure at fall heights greater than 23 feet above the ground below without a fall protection system   (d) employees were dropping roof waste over the edge of a roof structure at a height greater than 20 feet above the ground below without use of a waste disposal chute

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.     On Dec. 19, 2018, located throughout the residential roof structures of two 3-story apartment buildings, employees were observed performing roofing work while not utilizing a fall protection system. Potential fall heights were measured to be greater than 23 feet above the ground below.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.    On Dec. 19, 2018, employees were not provided with fall protection equipment before beginning roofing work at potential fall heights greater than 23 feet above the ground below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    The employer did not provide a training program for employees performing roofing work on a residential roof while not utilizing a fall protection system and exposed to fall heights greater than 23 feet above the ground below.
