29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     a. On or about February 9, 2019, employees used a Werner brand forty foot extension ladder to gain access and to egress the roof, the ladder was not extended three (3) feet above the upper landing surface and was not secured to prevent accidental displacement, exposing employees to a thirty (30) foot fall hazard.

The employer fails to assure effective protection against falls as required by the standard, as demonstrated on February 9, 2019, when employees of Robert E. White II, Inc. are working on the roof of a three story 4:12 pitch, residence without fall protection and are exposed to falls of approximately 30 feet to the ground below.    Robert E. White II, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1209382, citation number 1, item number 1 and was affirmed as a final order on 3/15/2017, with respect to a workplace located at 2780 Duffer Road, Sebring, FL 33872 and was assessed a penalty of $2173.00.
