29 CFR 1910.28(b)(1)(i)(A): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a standard guardrail system: Warehouse Area - In December 2018, employees were exposed to fall hazards when raised on a pallet supported by the forks of a forklift truck to access storage rack heights from approximately 5 feet to 14 feet above the floor, to affix grating, retrieve products from palletized loads, and perform inventory tasks. Employees wore a body harness with a 6 foot shock-absorbing lanyard that was choke-tied to the forklift's load backrest extension. This was an inadequate anchorage point and an ineffective use for a personal fall arrest system. Abatement documentation is required for this item in accordance with the requirements of 1903.19(d).

29 CFR 1910.30(a)(3)(iv): The employer did not train each employee on the correct use of personal fall protection systems and equipment, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer: Warehouse Area - In December 2018, employees were exposed to fall hazards when raised on a pallet supported by the forks of a forklift truck to access storage rack heights from approximately 5 feet to 14 feet above the floor and did not receive training in the proper use of personal fall protection systems and equipment. Employees wore a body harness with a 6 foot lanyard attached. The shock absorber end of the 6 foot lanyard was choke-tied around the load backrest extension and attached back onto itself, which was not a safe attachment nor anchorage point. Abatement documentation is required for this item in accordance with the requirements of 1903.19(d).

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: Warehouse Area - On or about February 14, 2019, the employer did not ensure that each employee authorized to operate a powered industrial truck had successfully completed training consisting of a combination of formal instruction through computer based training, videos, written exercises, etc. Operators did receive practical training and evaluation of operating performance. Employees were potentially exposed to struck-by injuries. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
