On or about February 19, 2019, located at The Fenimore Apartments at 6729 North Hamilton Road in Westerville, Ohio, employees were framing interior walls on Apartment Building #4 while exposed to struck-by and fall hazards. The employer failed to initiate and maintain safety and health programs related to employee performing framing work.

On or about February 19, 2019, located at The Fenimore Apartments at 6729 North Hamilton Road in Westerville, Ohio, employees were framing interior walls on Apartment Building #4 with the use of pneumatic nail guns without any means of eye protection, thereby exposing the employees to a struck-by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about February 19, 2019, located at The Fenimore Apartments at 6729 North Hamilton Road in Westerville, Ohio, employees were framing interior walls on Apartment Building #4 while there were sections on the north and south side on the 3rd floor of the building without exterior walls and guardrails, thereby exposing the employees to a fall hazard of approximately 22 feet. b. On or about February 19, 2019, located at The Fenimore Apartments at 6729 North Hamilton Road in Westerville, Ohio, employees walked across three walkways that were approximately 10 feet long by 24 inches wide to access each section of the apartment building without any means of fall protection, thereby exposing the employees to a fall hazard approximately 11 - 22 feet.
