29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about February 19, 2019, located at the Village at College Central at 1405 Leesland Drive (Lot 54), employees were installing siding from the top of a porch roof without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 13 feet.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed. a. On or about February 19, 2019, located at the Village at College Central at 1405 Leesland Drive (Lot 54), employees were installing siding from a six foot Louisville stepladder positioned on the top of a porch roof. The stepladder was folded and leaning against the house, which was not used for the purpose in which the ladder was designed, thereby exposing the employees to a maximum fall hazard of 15 feet.
