29 CFR 1910.147(c)(1): The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment was isolated from the energy source and rendered inoperative: a) Speedy Foods, LLC at 7033 E 49th Ave., Commerce City, CO, 80022: On and preceding 2/20/2019, the employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment was isolated from the energy source and rendered inoperative. Employees clean and perform maintenance on equipment such as, but not limited to: General Machinery Corporation S/M flaker, Model 3100, piston-driven food depositors, steam kettles/mixers, and the Butcher Boy meat grinder, Model A56. This condition exposed employees to laceration and amputation hazards.

There are seven (7) unguarded piston-driven, pneumatically-powered food depositors in the facility. Employees operate and work in the vicinity of the depositors. These conditions exposed employees to laceration and amputation hazards. b) Speedy Foods, LLC at 7033 E 49th Ave., Commerce City, CO, 80022: On or about 2/20/2019, one or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation and rotating parts. 29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) Speedy Foods, LLC at 7033 E 49th Ave., Commerce City, CO, 80022: On or about 2/20/2019 the employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). Of the 36 full-time employees at the food production facility only the sanitation employees are provided with safety glasses. Production employees process raw and cooked food product and work around pneumatically-driven machinery with pressurized air hoses that, if released suddenly, could lash out and strike employees in the eyes. These conditions exposed employees to struck-by and eye hazards.
