29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a Genie 4x4 Diesel 40' Telescopic Boom Lift, without fall protection equipment.  b)  West side of the commercial construction building:  On or about February 25, 2019, and at times prior thereto, employees were exposed to a fall hazard while welding the rail ways on the exterior building, from a JLG 400S Telescopic Boom Lift, without fall protection equipment.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.   West side of the construction site: On or about February 25, 2019, and at times prior thereto, employees without fall protection were exposed to a fall hazard greater than 15 feet to the unpaved ground below while welding the rail ways on the roof.
