29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  A) Shaban LTD. on or about February 26, 2019 at the address of 1138 North Bryne Road, Toledo, OH: The employer did not ensure employees were protected from head injuries while working below a spoil pile of soil and an excavator when cutting a waterline from inside of the trench. Due to this condition, employees were potentially exposed to impact injuries caused from falling clumps of heavy cohesive soil.

A) Shaban LTD. on or about February 26, 2019 at the address of 1138 North Bryne, Toledo, OH: The employer did not ensure employees were protected from soil falling or rolling into the trench by not placing the spoil (soil) pile at least 2 feet away from the edge of the trench. Due to this condition, employees were exposed to impact injuries caused from falling soil and cave-in hazards while working from inside of the trench.

A) Shaban LTD. on or about February 26, 2019 at the address of 1138 North Bryne Road, Toledo, OH: The employer did not ensure a competent person conducted daily inspections of the excavation / trench to ensure that employees were protected from hazards associated with trenching work.  Due to this condition, employees were exposed to hazards from accumulating water, undercut soil, spoil pile placement and inadequate cave-in protection.
