A) Kelly Brothers Construction, Inc. on or about February 26, 2019 at the site address of 500 Bender Road, Elyria, OH: The employer failed to ensure a safe means of egress, such as a ladder was placed 25 feet of the employees location within the trench. Employees shooting grade inside of a 18 foot deep trench, were exposed to hazards associated with inadequate egress.

A) Kelly Brothers Construction, Inc. on or about February 26, 2019, at the address of 500 Bender Road, Elyria, Ohio: The employer failed to ensure an employee was adequately protected from cave-ins while performing grade checking activities at the base of a 18 foot deep trench.    B) Kelly Brothers Construction, Inc. on or about February 26, 2019, at the address of 500 Bender Road, Elyria, Ohio: The employer failed to ensure employees were adequately protected from cave-ins while preparing the base of the 15ft deep trench for pipe laying activities.

29 CFR 1926.652(g)(2): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of a shield system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the shield.    A) Kelly Brothers Construction, Inc. on or about February 26, 2019 at the address of 500 Bender Road, Elyria, OH: The employer failed to ensure the bottom of the protective trench shield did not exceeded a height of 2ft from the base of the trench. An employee was exposed to trench wall failure when the bottom of the protective shield was 4 to 5 foot and 7 tenths above the base of the trench during pipe laying and manhole installation activities.
