29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: On or about 05/09/2019, the employer failed to certify to OSHA that the following hazards have been abated: (a) Citation 1, Item 1 - First floor interior: On or about 2/28/2019, and at times prior, the employer exposed employees to struck-by hazards while operating an electric Makita 7 1/4" circular saw, in that protective eyewear was not provided to employees engaged in lumber cutting operations. (b) Citation 1, Item 2 - Roof of the structure: On or about 2/28/2019, and at times prior, the employer exposed employees to fall hazards of up to twenty-two feet, five inches, in that the use of personal fall arrest systems was not enforced while the employees were roofing the top of a two story new-build house. (c) Citation 2, Item 1 - Company-wide: On or about 2/19/2019, and at times prior, the employer exposed employees to fall hazards, in that fall protection training was not provided prior to working at heights above six feet.
