29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Jobsite, 50 Oak Grove Road, Pine Grove - The employer did not ensure a competent person conducted an inspection of the trench at the start, and as needed while employees performed work activities from inside an 8 foot deep trench and allowed employees to enter the excavation without a protective system in place during the installation of a drainage pipe, exposing employees to struck-by and engulfment hazards, on or about March 5, 2019. In accordance with 29 CFR 1903.19, abatement certification and documentation is required for this violation.
