In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.28(b)(11)(ii): (ii) Each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as follows- On stairs with two open sides, the stairs did not have one stair rail system on each open side: Shark Glass Recycling, LLC, Lavonia, Ga - On or about February 28, 2019, employees were exposed to a fall injury where: (a) In the glass area @ the ladder to the crusher, employees were using stairs with 10 treads and 10 risers that did not have a stair rail system on both sides of the stairway. b) On the PVB side @ the ladder near the paper station, employees were using stairs with four risers that did not have a stair rail system on both sides of the stairway. c) On the PVB side @ the ladder leading to the hammermill, employees were using stairs with 14 risers or greater that did not have a stair rail system on both sides of the stairway. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The employer had not conducted monitoring to determine employees exposure to respirable crystalline silica and/or monitoring has to be repeated every three to six months until two consecutive measurements, taken 7 or more days apart, are below the action level. b)Shark Glass Recycling, LLC, Lavonia, GA - An employee driving a forklift was exposed to crystalline silica at 32.8 µg/m3 (micrograms of silica per cubic meter of air), 1.3 times the Action Level (AL) of 50 µg/m3 (micrograms of silica per cubic meter of air), on or about March 7, 2019. The employer had not conducted monitoring to determine employees exposure to respirable crystalline silica and/or monitoring has to be repeated every three to six months until two consecutive measurements, taken 7 or more days apart, are below the action level.
