29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On or about February 26, 2019 an employee was hospitalized after receiving serious injuries, after falling into a trench that was opened, the employer failed to report the hospitalization to the local Area Office within the prescribed 24 hour time table. The local Area Office was notified by an anonymous phone in on or about March 4, 2019. No abatement certification or documentation is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about February 26, 2019 at the worksite located at 1552 Laricks Lane in Lawrenceville, Georgia, employees were exposed to cave in hazards of a trench, when the employer failed to ensure that proper protection was in place prior to employees entering the trenching area. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
