OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards during pipe work at a tank that held oil and gas production water:       a. On or about March 4, 2019, at the west gun barrel tank which held oil and gas production water, the employer allowed employees to use a propane torch to heat an open fiberglass pipe of the tank top and exposed employees to fire hazards.

On or about March 4, 2019, at the top of west gun barrel tank, no connector that was drop forged, pressed or formed steel, or made of equivalent material was used between a fall protection harness and a polyester sling used as a fall protection lanyard.  A polyester sling end loop ran through the dee-ring of the fall protection harness to directly connect the fall protection harness to the sling.  The fall protection harness and sling were worn by an employee for personal fall arrest when working from the tank top which exposed the employee to falls greater than 6 feet to a lower level.
