29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).    a) On or about 3/12/19, in a trench in front of a house located at 115 Rutland Street, Buffalo, NY: An employee was in an unprotected trench making water line connections. The trench was approximately 5 ft. 4 in. to 5 ft. 10 in. deep with vertical walls. No cave-in protection was provided.     NO ABATEMENT DOCUMENTATION REQUIRED    PCS Plumbing & Heating, Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1280609, citation number 1, item number 1, and was affirmed as a final order on 2/15/18, with respect to a workplace located at 2860 North America Drive, West Seneca, New York, 14224.    PCS Plumbing & Heating, Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1068137, citation number 1, item number 2, and was affirmed as a final order on 9/03/15, with respect to a workplace located at 5165 Broadway Depew, New York, 14043.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identified them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a) On or about 3/12/19, in a trench in front of a house located at 115 Rutland Street, Buffalo, NY: A portable ladder was used by an employee to enter and exit from the trench.  Approximately the seventh rung up from the bottom of the ladder was missing.        NO ABATEMENT CERTIFICATION REQUIRED
