Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a struck by hazard: a) 2435 Brunner Road, Emmaus, PA, Worksite - on or about March 14, 2019, an employee was performing traffic control duties using a STOP paddle while standing in the active public traffic route without wearing high visibility safety apparel. Abatement note: Among other feasible means of abatement, the employer can follow the guidance of ANSI Z133 - 2012, Paragraph 3.2.3, which states: "Arborists and other workers exposed to risks of moving roadway traffic shall wear high visibility safety apparel meeting the requirements of ANSI/ISEA 107". ANSI/ISEA 107 - 2015 defines high visibility safety apparel as Personal Protective Equipment "intended to provide conspicuity to the user in hazardous situations under any light conditions by day and under illumination by vehicle headlights in the dark or other low light conditions".

29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: a) In Front yard of 2435 Brunner Road, PA - On or about March 14, 2019, one employee was working from a Topkick articulating boom aerial lift, approximately 20 feet above grade, without being tethered to the basket by a lanyard attached to a body belt.
