29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or before March 13, 2019, the employer failed to maintain a safety and health program, such as a fall protection program, thereby exposing employees to fall hazards while working at heights of up to 12 feet, 6 inches.  b. On or before March 13, 2019, the employer failed to maintain a safety and health program, such as a personal protective equipment program, thereby exposing employees to struck-by hazards.  Trail Builders, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1333202, citation number 1, item number 1A and was affirmed as a final order on September 28, 2018 with respect to a workplace located at Lot 78537550, Paradisio Dr, Galena, OH 43021.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or before March 13, 2019, where employees operated pneumatic nail guns, the employees' eyes were not protected from flying objects, thereby being exposed to struck-by or other hazards.  b. On or before March 13, 2019, where employees operated a circular saw, the employees' eyes were not protected from flying objects, thereby being exposed to struck-by or other hazards.  Trail Builders, LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1333202, citation number 2, item number 1B and was affirmed as a final order on September 28, 2018 with respect to a workplace located at Lot 78537550, Paradisio Dr, Galena, OH 43021.  Trail Builders, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1096426, citation number 1, item number 2 and was affirmed as a final order on November 12, 2015 with respect to a workplace located at 4649 King Medow, Kent, OH 44242

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or before March 13, 2019, where employees were preparing to stand up the second story walls of a single family house, the employees were not protected from falls, thereby being exposed to 10 foot 10 inch fall hazard.  b. On or before March 13, 2019, where employees were working on the second story of the house, the second story window openings were unguarded, thereby exposing employees to a 12 foot 6 inch fall hazard.  c. On or before March 13, 2019, where employees used a stairway to access the second story of the house, the open sides of the stairway were not guarded, thereby exposing employees to a 6 foot fall hazard.  d. On or before March 13, 2019, where employees used the stairway to access the second story of the house, the openings to the basement were not guarded, thereby exposing the employees to a 10 foot fall hazard.  Trail Builders, LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1333202, citation number 2, item number 3 and was affirmed as a final order on September 28, 2018 with respect to a workplace located at Lot 78537550, Paradisio Dr, Galena, OH 43021.
