29 CFR 1910.266(d)(1)(iv): The employer did not assure that each employee who operated a chain saw wore ballistic nylon leg protection or other  leg protection which the employer had demonstrated provides equivalent protection:        a) Logging site at 1729 NYS Route 9N, Ticonderoga, NY - On or about October 6, 2018, an employee was delimbing felled trees with a chainsaw during logging operations without the use of leg protection.  The employer did not ensure that the employee wore hip and leg protection while operating a chain saw to de-limb felled trees.

29 CFR 1910.266(d)(1)(v): The employer did not assure that each employee wore foot protection, such as heavy-duty logging boots, that were waterproof or water repellant, and/or that covered and provided support to the ankle, and protected the employee from penetration by chain saws:      a) Logging site at 1729 NYS Route 9N, Ticonderoga, NY - On or about October 6, 2018, an employee involved logging operations to include delimbing felled trees on the ground with a chainsaw was not wearing foot protection that protected the employee from penetration by a chainsaw.

29 CFR 1910.266(f)(3)(vii): Each machine manufactured after August 1, 1996, shall have a cab that is fully enclosed with mesh material with openings no greater than 2 inches (5.08 cm) at its least dimension. The cab may be enclosed with other material(s) where the employer demonstrates such material(s) provides equivalent protection and visibility. Exception: Equivalent visibility is not required for the lower portion of the cab where there are control panels or similar obstructions in the cab, or where visibility is not necessary for safe operation of the machine:      a) Logging site at 1729 NYS Route 9N, Ticonderoga, NY - On or about October 6, 2018, an employee was operating a Timberjack, Model 240-A logging skidder with the driver's side door removed from the vehicle exposing the employee to a crushing hazard.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:      a) Logging site at 1729 NYS Route 9N, Ticonderoga, NY - On or about October 6, 2018, an employee was struck on the head by a falling tree limb resulting in a fatality. The employer did not report the fatality to OSHA.
