29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Jobsite, Somerset & Timber, Windber, PA: On or about March 19, 2019 there was no ladder, stairway or other safe means of egress in the trench that measured approximately 70 inches in depth and ran approximately 25 ft. long east to west and 21 ft. north to south. An employee was observed jumping in the trench and climbing the side walls to exit.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Jobsite, Somerset & Timber, Windber, PA: On or about March 19, 2019 employees had not been trained in the recognition and avoidance of unsafe conditions while working in and around trenches or what methods or means could be used to protect themselves from such hazards. Employees had not been trained to recognize hazards such as but not limited to: struck by or entrapment from cave-in hazards, safe means of egress into and out of the trench, soil types and conditions, the accumulation of water, traffic control and overhead electrical lines.
