29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a)   Employees were exposed to hazards associated with pulmonary and cardiovascular injury/illness.  Employees performing painting activities were required to use tight fitting, half face respirators. A medical evaluation to determine the employee's physical ability to use a respirator had not been provided by the employer.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  Employees were exposed to chemical hazards.  Employees engaged in painting activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the paint with which they work.

Employees engaged in painting activities were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. Employees had not been provided with training or information regarding the hazardous chemicals with which they work.
