Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Residential construction. Front Section of Roof: On or about 03/28/2019, and at times prior, the employer exposed employees to falls 8-feet, 10-inches to the lower level, in that the employees were not provided with a fall protection system while engaged in roof activities on a 8:12 pitched roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Residential construction. Front section of Roof: On or about 03/28/2019, and at times prior, the employer exposed employees to falls from a 8:12 pitched roof with eave heights at 8-feet, 10-inches from the lower level, in that employees were not provided training in the recognition of the hazards and conditions of working at heights when fall protection systems are required to be used while installing roof shingles.
