29 CFR 1926.102(a)(1): The employer is failing to ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:     The employer is failing to protect employees from struck-by hazards associated with using pneumatic nail guns without wearing approved eye protection.  The most recent occurrence of this was observed on March 28, 2019 at 7310 Swiss Alps, Lincoln, NE 68516 where the employer has employees using pneumatic nail guns to secure sheeting on a roof without wearing any ANSI approved eye protection.

The employer is failing to ensure each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system:    The employer is failing to ensure that all employees exposed to fall hazards while framing a residential roof are utilizing fall protection. This most recently occurred on March28, 2019 on the jobsite located at 7310 Swiss Alps, Lincoln, NE 68516. Two employees were observed sheeting the roof of a one-story residential building at heights greater than six feet above the ground while not utilizing any form of fall protection.

29 CFR 1926.503(a)(1): The employer is failing to provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    The employer failed to train all employees that were potentially exposed to fall hazards to enable each employee to recognize the hazards associated with the type of work being conducted on or about March 28, 2019 on a residential construction sit at 7310 Swiss Alps Ave, Lincoln, NE 68516.  This should include training on mitigating those hazards through an acceptable method of fall protection.  Training should also include the requirements for fall protection systems and when it is appropriate to utilize those systems.

29 CFR 1926.503(b)(1): The employer failed to verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training:    The employer is failing to provide documentation of fall protection training for employees to the CSHO on or about March 28, 2019 at a residential construction site at 7310 Swiss Alps Ave, Lincoln, NE 68516.  The employer had employees performing framing activities that had not received fall protection training.
