OSH Act of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:    a) 185 Hamilton Ave Paterson, NJ/Roof A: A employee was exposed to fall hazard of approximately 30 feet while using a RGC Platform Hoist as a ladder to access the 6/12 pitched roof of a residential house, on or about 3/28/2019.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Building Exterior/Roof A: An employee was using a pneumatic nail gun while installing roofing material without the use of eye and face protection, on or about 3/28/2019.   b) Building Exterior/Roof B: An employee was using a pneumatic nail gun while installing roofing material without the use of eye and face protection, on or about 3/28/2019.   The FM Winters 1 LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1290333, citation number 1, item number 2 and was affirmed as a final order on 8/31/2018, with respect to a workplace located at 248 Passaic Ave, Passaic, NJ 07055.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Two Story Family Home/Roof A: An employee performing work on a 6/12 pitched roof was exposed to a fall hazard of approximately 30 feet while working without personal fall arrest system or other means of fall protection, on or about 3/28/2019  b) Two Story Family Homes/Roof B: An employee performing work on a 6/12 pitched roof was exposed to a fall hazard of approximately 30 feet while working without personal fall arrest system or other means of fall protection, on or about 3/28/2019   The FM Winters 1 LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1290333, citation number 1, item number 3 and was affirmed as a final order on 8/31/2018, with respect to a workplace located at 248 Passaic Ave, Passaic, NJ 07055.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a) Two Story Family Homes/Roof: The employer did not ensure that employees who are engaged in roofing work at an approximate height of 30 feet above the ground surface, were trained to recognize and avoid hazards, thus exposing employees to a fall hazard, on or about 3/28/2019.
