On or about April 2, 2019, located at 4015 Hampshire Avenue in Powell, Ohio, the employer did not initiate and maintain safety and health programs for employees when performing shingle tear-off and install, thereby exposing the employees to the hazards associated with roofing work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about April 2, 2019, located at 4015 Hampshire Avenue in Powell, Ohio, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the regulations when working from heights, climbing ladders, etc., thereby exposing the employees to the hazards associated with roofing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a. On or about April 2, 2019, located at 4015 Hampshire Avenue in Powell, Ohio, employees were performing roofing work without any means of fall protection, thereby exposing the employees to a fall hazard between 10 to 30 feet.     b. On or about April 2, 2019, located at 4015 Hampshire Avenue in Powell, Ohio, employees were performing roofing work near two skylights without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 15 feet to lower surface.
