29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) a) Wall Custom Homes, LLC located at 6996 E Archer Place, Denver, CO 80230: On and before April 3, 2019, the controlling employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person. Concrete subcontractors employees were working in a basement excavation next to the face of the unprotected sections preparing to install forms prior to pouring concrete. The unprotected sides of the excavation were over 7 feet and the workers were within 1 foot of the face. The concrete contractor did not plan and carry our the work in a manner that would limit the time the employees were working near the excavation. The controlling employer did not perform inspections of the excavation or adjacent areas to ensure that adequate protection was in place prior to starting work or at any point after employees entered. The following condition exposed employees to caught-in and struck-by hazards.
