29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l); as reference in CFR 1926 602(d).    On April 3, 2019 at 445 Royal Saint Pats Drive in Wrightstown, the employer did not ensure that the employee operating an Ingersoll Rand Rough Terrain forklift was competent to safety operate a powered industrial truck as demonstrated by the successful completion of the training and evaluation required.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  On April 3, 2019 at 445 Royal Saint Pats Drive in Wrightstown, an employee was working from a platform supported by an Ingersoll Rand rough terrain forklift without the platform secured to the fork at eight feet above surface level.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On April 3, 2019 at 445 Royal Saint Pats Drive in Wrightstown, employees were working on a roof surface at ten and one half feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On April 3, 2019 at 445 Royal Saint Pats Drive in Wrightstown, the employer did not provide required fall protection safety training for employees who did not associate fall from elevation hazards when working on a roof surface ten and one half feet above surface level without utilizing fall protection equipment.
