29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  New residential construction located on Lot #38, East side:  On or about 04/03/2019 the employer exposed employees to falls of over 25-feet to the  lower level, in that a fall protection system was not provided to employees engaged in siding installation activities on a pump jack scaffold system.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.  New residential construction located on Lot #38, East side: On or about 4/13/2019, and at time prior, the employer exposed employees to collapse/fall hazards while working at heights over 25-feet to the lower level, in that pump jack scaffold support poles were not secured at the base to prevent movement while engaged in siding activities. The supports were not plumb/level as they had moved as a result of not securing at the bottom prior to the start of work.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  New residential construction located on Lot #38, East side:  On or about 04/03/2019 the employer failed to inspect all of the electrical cords and electrical equipment prior to the start of the work shift, in that electrical cords used to power circular saws had damaged female connectors exposing the internal insulated circuits.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  New residential construction located on Lot #38, East side near cut bench: On or about 4/03/2019 the employer failed to use electrical outlets suitable for outside/weather rated usage, in that a power strip rated for indoor usage was used to power circular saws and other electrical equipment on site. The power strip was not used as intended by the manufacturer.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  New residential construction located on Lot #38, East side: On or about 04/03/2019, and at times prior, the employer failed to train employees to recognize fall hazards, in that employees were not provided training to minimize fall hazards while working on a pump jack scaffold installing Hardie-Plank Siding at a height of over 25 feet.
