29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a) On or about April 10, 2019, and at times prior thereto, the employer did not instruct employees in methods to control and/or eliminate potential cave-in hazards prior to working in trenches and excavations.   Employees were working to install an irrigation pipeline in a trench at a approximated depths ranging from 4.0 to 8.0 feet.    Abatement certification AND documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift.    a) On April 10, 2019, and at times prior thereto, for the trench excavated,  Employees were working to install a irrigation pipeline in an excavation at a depth ranging from approximately 4.0 to 8.0 feet.  Inspections were not completed for the potential cave-in hazards such as but not limited to, unstable soil, wet soil, no ladder for access/egress, lack of training, spoils moved back off the walls and/or protection from loose rocks.     Abatement certification AND documentation are required for this item.

Abatement certification and documentation ARE required for this item.
