OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of heat-related illness:   a) On or about and at times prior to April 12, 2019, employees were exposed to conditions of high ambient heat from the sun during the performance of their job duties, including citrus harvesting. A calculated Wet Bulb Globe Temperature (WBGT) ranged from 73.7°F to 82.1°F while working outdoors performing moderate manual labor and wearing long sleeves and pants.  The corresponding heat index values were 72.0°F to 86.0°F. These conditions can result in heat illnesses, including heat exhaustion and heat stroke, in workers who are not acclimatized.
