29 CFR 1926.21(b)(2): (Employer responsibility.) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about the 6-day period of April 11 - 16, 2019, located at a residential jobsite, employees were working inside a trench excavation of 12 feet in depth (deep end) and at a depth greater than 6 feet (shallow end). The employer did not instruct employees in the recognition and avoidance of those trench excavation hazards of which a reasonably prudent employer would have been aware of while performing this work.

29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. (a) On or about April 12, 2019, located at a residential jobsite, an employee was exposed to struck-by hazards while working inside a trench excavation of 12 feet in depth without use of eye protection. (b) On or about April 15, 2019, located at a residential jobsite, an employee was exposed to struck-by hazards while working inside a trench excavation at a depth greater than 6 feet without use of eye protection.
