29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Roof - The employer did not have a competent person on the job site in that none of the employees who worked on the site on April 17, 2019 inspected the job site, identified predictable fall hazards, and took immediate actions to correct the hazards.  As a result, employees did residential roofing work on a two-story single-family home without using fall protection and without extending the ladder used to access the roof three feet above the landing surface, exposing the employees the hazard of falling to a lower level.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a) Roof - Employees did roofing work, including removing old shingles and installing new shingles, on the two-story single-family home, which had an eave height of 21 feet above the ground at the front of the house.  The employees did not use guardrail systems, safety net systems, or personal fall arrest systems for fall protection nor did they use an alternative fall protection measure, exposing the employees to the hazard of falling to the ground below, on or about April 17, 2019.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Roof - To gain access to the roof, employees used a portable extension ladder, positioned at the front of the house.  This ladder only extended two feet above the roof (upper landing) surface, exposing the employees to the hazard of falling 21 feet to the ground below, on or about April 17, 2019.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
