29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:   Or in the alternative   Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  (a) On or about April 13th, 2019, and at times prior, for the employees who were exposed to multiple struck-by and fall hazards while installing exterior building wrap from a man basket in excess of ten feet high; where the basket was not attached to an all-terrain forklift and being used beyond the load allowable load center distance, CAT all-terrain forklift TH514, in the vicinity of 900 43rd Avenue NE in Bismarck, ND.
