29 CFR 1926.451(b)(10): Scaffold components manufactured by different manufacturers shall not be intermixed unless the components fit together without force and the scaffold's structural integrity is maintained by the user. Scaffold components manufactured by different manufacturers shall not be modified in order to intermix them unless a competent person determines the resulting scaffold is structurally sound.   a.  Located at 7344 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not ensure that the pump jack scaffold used by the employees was not modified.  The employees modified and intermixed the scaffold components, without the determination of a competent person.  Two employees were exposed to a fall hazard of approximately 20 feet, without any fall protection or mitigation, while they installed siding to a new build residential home.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at 7344 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not provide a training program for employees to recognize and provide procedures to be followed, when they might be exposed to a fall hazard.  Employees performed siding work from the garage roof top and a modified pump jack scaffold system, and were exposed to a fall distance of 11 feet and approximately 20 feet respectively.

Located at 7344 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not maintain a safety and health program to ensure hazard detection, and correction while performing siding work onsite.  Employees were unprotected from the garage roof top of a new build residential home, and off the modified pump jack scaffold.  The fall distance was approximately 11 feet and 20 feet respectively to the ground.  Kevin Ramos was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1359157, citation number 1, item number 1A and was affirmed as a final order on January 22, 2019, with respect to a workplace located at Lot 169095, Balmoral Drive, Delaware, OH 43015.

Located at 7344 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer failed to instruct employees on the avoidance of unsafe conditions while performing work at a new build construction worksite, while an employee worked off the top of the garage roof.  Kevin Ramos was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1359157, citation number 1, item number 1B and was affirmed as a final order on January 22, 2019, with respect to a workplace located at Lot 169095, Balmoral Drive, Delaware, OH 43015.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a.  Located at 7344 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not ensure that two employees who worked off the pump jack scaffold, were protected from falling to the ground level.  The employees were greater than 10 feet above the ground level.  The employees installed siding off the scaffold onto a new build residential home, and were exposed to a fall distance of approximately 20 feet. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.
