29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 2776 Enterprise Drive, Opelika AL; On or about April 24, 2019 and at times prior thereto the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injuries. Employees were working in eight to ten foot deep trenches with near vertical walls without any safety training regarding trenching and excavation work.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) North Side of 2776 Enterprise Drive, Opelika AL; On or about April 24, 2019 and at times prior the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring seven feet six inches deep, eight feet wide, and fifteen feet in length that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal). a) South Side of 2776 Enterprise Drive, Opelika AL; On or about April 24, 2019 and at times prior the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring nine feet six inches deep, eight feet wide, and fifteen feet in length that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
