29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Walker Commercial, Inc., 17700 E Colfax Ave Aurora, CO 80011: On and before May 1, 2019, the exposing employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. An employee working inside a trench with near vertical walls was not protected from cave-in, in that this employee was working in the trench installing water line connections in a trench approximately 5 feet 8 inches deep and 4 feet across while it was raining without protective systems in place. The employer did not instruct this employee in the recognition and avoidance of unsafe conditions and the regulations of trench and excavation hazards. This condition exposed this employee to a crushing, struck-by, and cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Walker Commercial, Inc., 17700 E Colfax Ave Aurora, CO 80011: On and before May 1, 2019, the exposing and controlling employer did not ensure that daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person for evidence of possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Employees were installing water connections in a trench approximately 5 feet 8 inches deep while it was raining without protective systems in place. An inspection was not conducted by the competent person to ensure that employees were not exposed to struck-by, caught-in, or cave-in hazards.
