29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On April 23, 2019, located at a residential structure, there were no frequent and regular inspections being performed by a competent person in that employees: were not provided fall protection gear before beginning work from an aerial lift at elevation; were operating an aerial lift in an occupied apartment building parking lot that did not have an established and marked danger zone around the vehicle perimeter at ground level; and were performing work from a JLG 660-SJ extendable boom lift without being tied off.

29 CFR 1926.21(b)(2): (Employer responsibility.) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On April 23, 2019, located at a residential structure, employees were operating a JLG 660-SJ extendable boom lift that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.

29 CFR 1926.453(b)(2)(v): ("Specific requirements.")(Extensible and articulating boom platforms.) A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On April 23, 2019, located at the northwest side of a residential structure, employees were observed working from a JLG 660-SJ extendable boom lift without being attached to the boom or basket. Potential fall heights were measured to be greater than 18 feet above ground level.
