29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a)Blackwing Elite Builders, Inc. at 1310 West 30th St. Yankton, SD 57078: On or about and at times prior to August 14, 2018, the controlling employer did not ensure a forklift operator was trained in the operation of powered industrial trucks in that, a subcontractor employee was not trained in the use of the JBC507-42 Rough Terrain Forklift that was rented by the general contractor. This condition exposed the employee to the hazard of improper forklift operation. Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.20(b)(2): The employer did not provide for frequent and regular inspections of the job sites, materials, and equipment or ensure inspections were made by competent persons designated by the employers: (a)Blackwing Elite Builders, Inc. at 1310 West 30th Street, Yankton, SD 57078: On or about and at times prior to April 24, 2019, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. A subcontractor employee was not provided training prior to operating a JCB rough terrain forklift that was rented by the general contractor to provide siding material to a subcontractor working on pump jack scaffolding. A subcontractor employee was exposed to an approximate thirty-foot fall hazard while using the pump jack scaffolding with inadequate guard railing in the form of netting. A subcontractor employee was also exposed to a fall hazard through a window opening while removing trash from the second floor of the structure under construction. The conditions exposed subcontractor employees to fall and struck-by hazards. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than ten feet above a lower level was not protected from falling: (a)Blackwing Elite Builders, Inc. at 1310 West 30th Street, Yankton, SD 57078: On or about and at times prior to April 24, 2019, the controlling employer did not ensure subcontractor employees working from pump jack scaffolding located on the east side of a multi-family structure under construction were protected from falls. The pump jack scaffolding was not equipped with guardrails at the end of the platform and had an approximate 2-foot gap between the netting that exposed an employee to a fall hazard. A subcontractor employee was exposed to a fall hazard of approximately 30 feet while working on the pump jack scaffolding.
