29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2):    (a)  Super Otter #1, Stern:  On or about May 7, 2019 and at times prior thereto, rope top rail at the leading edge measured 31.5 inches (at slack) in height.  This condition exposed employees to a fall hazard of 9 feet, 6 inches to the concrete floor below.    (b)  78 foot Catamaran:  On or about May 7, 2019 and at times prior thereto, rope top rail adjacent to the port stair access from the work floor measured 36 inches (at slack) in height.  This condition exposed employees to a fall hazard of 12 feet, 4 inches to the concrete floor below.    (c)  St. Phillip:  On or about May 7, 2019 and at times prior thereto, rope top rail adjacent to the port stern vessel access measured 29 inches (at slack) in height.  This condition exposed employees to a fall hazard of 9 feet, 6 inches to the compacted gravel surface below.

29 CFR 1915.81(a)(3): The employer stored materials in a manner that created a hazard for employees:    Paint Locker:  On or about May 7, 2019 and at times prior thereto, three (3) drums of 35% Technical Grade Hydrogen Peroxide were stored adjacent to and within seven (7) feet of flammable paints and solvents.  This condition exposed employees to incompatible chemical storage, fire, and decomposition hazards.

29 CFR 1915.133(a): Unsafe hand tools were issued and allowed to be used:     Super Otter #2:  On or about May 7, 2019 and at times prior thereto, a DeWalt model number D28402N, serial number 276999 right angle grinder was modified and used in a manner contradictory to the tool manufacturer's written instruction manual.  A 4.5 inch, toothed, saw blade was attached for beveling welds.  This condition exposed employees to laceration and amputation hazards.

29 CFR 1915.504(b)(2): Fire-resistant guards or curtains were not used to prevent ignition of combustible materials on or near decks, bulkheads, partitions or overheads:    Super Otter #2:  On or about May 7, 2019 and at times prior thereto, fire-resistant guards were not used to prevent ignition of combustible materials adjacent to the partitions where hot work was conducted.  This condition exposed employees to smoke-inhalation hazards.
