The employees were exposed to being struck by objects and/or tools falling from a height greater than 8 to 16 feet.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: On or about May 9, 2019, employees installing stucco from (2) tier tubular welded frame scaffolds that was not designed by a qualified person. The employees were exposed to a fall hazard of up to 16 feet to the ground below. Employees performing stucco installation from tubular welded frame scaffolds that were not designed by a qualified person. The scaffolds used were not fully assembled, did not guardrails, toe boards or a ladder to access the scaffold system.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about May 9, 2019, at a commercial construction site, masonry employees were applying stucco from a (2) tier tubular welded frame scaffold from the 2nd level of the scaffold without fall protection. The employees were exposed to a fall hazard of approximately 12 feet to the ground below.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about May 9, 2019, at a commercial construction site, masonry employees applying stucco from a (2) tier tubular welded frame scaffold were not provided with a ladder or other safe means of access. The employees were exposed to fall hazards of approximately up to (16) feet to the ground below.
